Hi,
I am on h1b status and my wife is on h4. She applied for an h1b(COS) this year (FY 2011) and the application has been approved. We received all the documents regarding H1b approval(except I-94). her employer said that we won't get an extended I-94 in this case.
My concerns are,
our visa's are getting expired on Sep 23(as per I-94 on visa its till 30Sep) and my company is planning to extend both H1B and H4. As she would be able to start work only from Oct 1 2010 and the visa is expiring on Sep 23, I think we have to extend her visa to avoid out-of-status. If I extend her h4 will it make her already approved H1b invalid?
if its required to extend the H4 is it mandatory to start working on 1 Oct 2010? (she is pregnant now and due is on Nov 2010 , so cannot start on Oct-1)

We have organized an Immigration Voice booth this Saturday August 18th at Pierce College, Woodland Hills at the IALA (India Independence) event. 14,000 people attended this event last year. Our aim is to talk to the general public about our issues, increase our membership and to generate publicity for the DC Rally. We will be handing out printed material, giving presentations and discussing our issues with the public.
The booth will be open from 3pm to 11pm. Come volunteer at the booth or visit us on the day. For more information on how you can volunteer, join the Southern California chapter here:

Note: We are aware that retrogression is a problem that affects people from all nationalities, however, due to the vast number of visa holders of Indian origin, the idea to take part in this event was proposed by a few members in our group. -> I am planning to change job now.
-> Question is; should I file for H1 Xfer or just take my chances with EAD?
The request is for an immigration attorney that can help my new employer file H1 Xfer and AC-21.

i got my i140 approved ,i-485 applied >180 days with my old employer.i have my h1b till 2010.Now i got an offer from a new company who is willing to do my h1b transfer and they said no need for doing labour,i140 again.
i am confused. is that safe if i do h1b transfer and keeping old employer's i140.(they won't revoke).Are its better to use ead to avoid confusion in GC process.pls show me the light.

I am currently working on F1-OPT with company A. Company A filed for my
H1B visa and it got approved, which is yet to start from Oct 2010. But now I
got an offer from Company B. I have to get my H1 transferred to company B.
I have informed my current employer(Company A) about this transfer.
But actually they(company A) are planning to withdraw my H1B visa petition
from USCIS as I will not be working with them from Oct 2010.
I would like to know if this will affect my visa transfer.
Can someone please let me know how it works and suggest me what should I do
to get my transfer done?

You can transfer your H1B before Oct. There is an option in the H1 application for that. I don't remember the exact wording, but one of my friend did this last year and it was approved.

You can transfer your H1B before Oct. There is an option in the H1 application for that. I don't remember the exact wording, but one of my friend did this last year and it was approved.

The key might be that your current employer should be able to give you some kind of letter that details your job duties, etc.
If this letter can allude to the duties in your original labor that's all your attorney would need to make your case.

I left my GC Sponsered company in Oct 2008 and started working on EAD.. >> Filled AC21 in N0v 2008 thru a consulting company >>
Got RFE on employment verification on May 2009.. replied and have no comments from USCIS yet.. (assuming everything is okay as their repsonse time 60 days elapsed)
Now got rolled out from project and no paycheck form since june 2009
and Now found a project but the vendor wont do corp-to-corp..but only W2...
THIS CASE CAN I JOIN WITH this Vendor ON W2 With out applying for one more AC21??
Appreciate your ideas.. thanks lot

Since EB-1 does not need labor certification, the process is completely independent of EB-2. As such you cannot "port" your EB-2 application the way people transition from EB-3 to EB-2. You will have to apply directly to USCIS with evidence of your "extraordinary ability" in your field, such as honorable membership of professional bodies, research track record, letters from well-known people in your field etc. The first stepto convince USCIS about exceptional ability is very involved, but there on I-140 and I-485 should proceed far more smoothly than EB-2.
