Of course you can start PERM in your 6th year. Make sure you do it soon and file for I-140 promptly so that once that is approved you can get 3 yr H1 approval

Please do not rely on Indian Media for immigration news.
They have covered their bases by putting "May" in the headline. "May" increase visas.
There is already a discussion that happened about this on another thread. Please search the forums for the article before starting a new thread.
And for heaven's sake, please dont look for immigration related news in Indian Newspapers. They dont know that congress has two chambers : House and Senate. And they dont know the common basics of legislative process in USA.

I was thinking I'm the only one waiting for the inventory data eagerly.I just stopped short of opening a thread though:)
As ridiculous and pathetic as it may sound in our case, Homo sapiens like to wait for something good or in 'hope' for the good to come.
While waiting for GC eternally, we learned to wait for VB each month,Demand Data used for VB each month,Inventory Data released quarterly. Of course, for all the analysis & comments that come out of each of these data points.
If it helps any, don't expect it before Tuesday/Wednesday next week.
Have a wonderful long weekend y'all!

Hi IV Gurus,
My Attorney filed my EAD application with invalid A# number in May,08 and my EAD got approved in July,08 with Invalid A# number. While going through my EAD card, I found invalid A# number on my EAD Card.
I sent a email to attorney regarding this one and he says that they filed EAD with invalid A# number and USCIS approved the EAD with Invalid A# number.It should not be an issue and the only way to �fix� this would be to file a new I-765 application and get a new EAD. It is certainly not an issue for employment eligibility at your current company".
Attorney also saying that they can file new EAD, but he needs send my Original EAD card along with the application.
My Questions are
1).Do I need send my Original EAD along with new EAD application ? Can I file with new EAD application with photo copy of my current EAD ?
2). Can I keep my current EAD (with Invalid A# Number on it) and apply next re-newel period with correct A# Number?
3).If I leave the country, while coming back at Port Of Entry do I see any problem? My I-485 and AP with valid A# Number and EAD with Invalid A# Number..
4).Do I see any issue, if I switch job with current EAD with Invalid A# Number?
Please give your suggestions.

Following is the situation:
My H1 (6 years) expiring on 7th Mar'08 (have 35 days of vacation might be good till 11th Apr'08)
Labour filed on 06/20/2007 , still awaiting..(so 365 days rule does not apply for 7th yr ext)
Spouse was on H4, got H1 in Oct'2007 (no stamping done for H1).
Falling short of 10 weeks to get the 365 days rule
Options that I learnt for me getting 7th yr extension and staying in the country:
Option1:
Convert to H4 toward the end of H1 6 yrs expiry date till June 20th(to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Convert from H4 to H1 and start working.
Option 2:
Get Canada working visa (not sure how long it will take to get though) and work till June 20th there (to get the 365 days rule in effect)
File for 7th year extension based on the 365 days rule
Stamping in canada to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 3:
Go back to India for 3 months wait till June 20th,
File for 7th year extension based on the 365 days rule
Stamping in India to return to USA.
(I am hoping 7th year extension can be done while I am outside the country)
Option 4:
Leave for India immediately and stay there for 10 weeks and recapture them along with 7th year extension(while I am in India )

On this case, I am getting mixed anwsers
Employer's lawyer is saying that i can continue to work since have valid I-94 and they are going to appeal. Lawyer called USCIS officers and USCIS officers confirmed this ( !!!).
Second lawyer is saying that i should stop working on denied petition.
Once you apply for appeal or motion your H1B peition status changed from 'Denied' to 'Pending' and you may continue to work for employer. - this is my guess
In fact, I am planning to get advice from murhty too...
Any thoughts on this.

I was on H1 status but got laid off. I have my EAD and my AP has been approved but I have not yet received it in the mail. Once I do, is it safe to travel outside the US and re-enter using AP if i don't have job yet?

we applied ap in octoer and we got receipt on oct 24th but we found a typo error on my daughters receipt instead of 'ekthasruthi sakala' it was ektha sakala' will it be a problem at the port of entry . please suggest me.
The name on the AP should match with passport. Make sure your 131 form has a correct name, if yes then you can reapply for a AP without a filing fee otherwise you have to pay. BTW, check all your receipts whether it has a correct name

As far as I know both the client and vendor letters should state the same and it is good if you have it for 3years.
At least see if your manager is willing to give you the letter on company letter head.

All options are possible, depends on your personal preference. There is NO good answer.
If your spouse is in H1B and have a stable income, I would suggest the H4 path.

Currently i have been on LOP for almost 5 weeks now..
what do you think would be a good option for me:
a.) Start the process for H4..and find a new job..and transfer H1 and stay till H1 is valid till may 2010..
b.) Be on bench for few more weeks.. and hope someting will work out...(firm has said they wont cancel my h1/140).. they are just being helpful..but?
c.) R2I ASAP...and try for a consular processing....?
d.) go to H4...and R2I in May...then if the Eb2(Dec 2005) dates are current..try for a CP..its a long shot...
