I have no US visa stamped in my passport and planning to fly Emirates to India via Dubai. I will use AP for re-entry. Do I need transit visa at Dubai like London and other European Airports? Response from anyone with experience will be appreciated. If already discussed here, guidance to particular forum will help.

I have completed 3.5 years of my H1B and am looking at the possibility of applying for GC either under EB2/3.
After my 12th, I did a 2 year Diploma in Business from Australia and then did a 2 year MA(History) in correspondence (open uni) from India and also a 1 year PGDCA by correspondence.
I have more than 10 years of IT experience to go with my 12+2(fulltime)+3(correspondence)years of education.
Questions:
Please advice if I qualify for EB2 and if so will there be any issues ?

Hi,
My I140 got denied early this year and the appeal is pending. Processing times for the appeal is 22 months. My priority date will be current next month. Because of that i am considering to refile my I140 and 485 again and withdraw the appeal.
1) Can we refile I140 with the same category (EB2)
2) Can USCIS just deny the new I140 because of the earrlier denial
3) Is there any one who tried this. What is the outcome of the new I140 application.
Please share your experience and also please advice

My wife recently went for a H1B renewal stamping in india. They visa officer provided a 221(g) administrative processing (pink) requesting additional documents (job description, reasearch projects, previous visas list etc..,). She is preparing the necessary docs to submit the same. Since she went to india for a short trip (travelling back next week).
1. She has Advanced parole. Can we use Advance parole??
2. If we use Advance parole, then once the Adminstrative processing is complete, how do we handle the stamping?? Do we need to go back again to the consulate to get the stamping done? or is there a way to withdraw the visa application from the consulate??
I would greatly appreciate if someone is similar situation share their experiences

Hi,
My Company recently started Perm process and posted ads in newspaper and jobsites. We have recieved couple of resumes. One of the resume meets almost all requirements, but doesn't have enough experiance in one skill set and also doesn't have required Bachelors Degree
Do we need to do interview candidates before rejecting?

The U.S Department of State (DOS) has advised that there are no more employment-based visa numbers available for fiscal year 2009, which concludes September 30, 2009. This affects all employment based categories, but particularly applicants in the employment-based non-ministerial fourth category (EB-4). The EB-4 non-ministerial category includes religious occupation, vocation and professional categories (but not the ministerial category).
The non-ministerial EB-4 category is set to expire September 30, 2009 and individuals in this category must have their adjustment of status applications approved or if they applied via consular processing, they must be admitted into the United States by midnight by September 30, 2009. Unless Congress extends the sunset provision, individuals in the EB-4 non-ministerial category are unable to file Form I-485 Adjustment of Status Applications or consular processing applications after September 30, 2009.
While the I-360 religious worker petitions (ministerial and non-ministerial categories) may still be filed before September 30, 2009, given the unavailability of visas in the EB-4 category the month of September, the Applications to Adjust Status (Form I-485) or applications for consular processing will not be accepted this month. Thus, adjustment of status applications that remained pending will not be approved unless a visa number had already been captured.
Individuals in the EB-4 ministerial category are eligible to file Adjustment of Status applications until October 1, 2009, when visas in the EB-4 category become available. I received GC with my wife and one minor son. Other minor son's status did not change. Today I am seeing following hard LUD on my son's I-485.
Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: This case has been sent for a standard interview.
On August 21, 2008, we transferred this case to our NATIONAL BENEFITS CENTER location to conduct the interview that is a standard part of processing this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS. You will be sent a notice when the interview is scheduled, or if the office needs something from you. If you move while this case is pending, call customer service.
Do I need to worry? Normally for employment based adjustment of status, interview is not required. Could this be USCIS error? Do I need to do anything?

I recently found out that someone had stolen my credit card information to purchase items online. I have since then closed that credit card and went ahead and put a fraud alert for 90 days on my credit report. I don't believe my SSN was stolen, but I want to check my credit report and also for protection have the alert so that no one tries to apply for loans etc. using any of my information.
Will having the fraud alert have an impact on my 485 filing in any way? Let me know what the best process is to handle this if it does have an impact on 485 background checks, and pending green card approvals etc.
I have no criminal history.

Fraud alert does not go into your permanent credit report. All this does it is that when you try to open a new loan/credit account, the lender will see that there is a fraud alert on your profile and may call you to verify. It should not have any effect on your I-485.
I have been thinking of signing up with lifelock.com. You may wanna check them out.

I currently have approved EAD, I-140 and waiting for a Visa number to become available. My receipt date for I-485 was July 2nd 2007 and my notice date was September 27th. My employer is closing the IT department in March. Though it has been 180 days since my receipt date, it's not 180 days since my notice date. Will my I-485 processing be impacted when a Visa number becomes available? Also, will it be Ok if I'm out of a job for a short time while I'm looking for my next job? I sincerely appreciate the help and guidance in this matter.
